ETICKETS.HK platform ("ETICKETS", Company", "we", "us" and/or "our") is an event technology platform to provide all the tools you need to create and promote online reservation and ticketing services effectively that allows project organizers to facilitate event management by set up registration, reservation, ticket sales, onsite ticket check-in, publish and promote events. A registration page is simply created that enables attendees to find, purchase tickets and process orders. Only our members with user accounts can process their orders in the registration page in order to protect attendees and organizers. We will set up an unverified user account and process your order at the same time if you have not registered in our platform. All non-profit projects for free admission, free ticket sales, free reservation and free registration are free. All free tickets are not allowed to charge attendees. We make it easy as a tool for everyone to discover projects, and to share the projects they are attending with the people they know. We do this through our mobile applications, websites and domains, the services available on or through our mobile applications, websites and domains or otherwise provided by us, and the software available on or through our mobile applications, websites and domains or otherwise provided by us (collectively, the "Services", the "Service"). All users (either Organizers or Attendees) of ETICKETS platform agree the Terms & Conditions of Service which may be modified from time to time without prior notice. By continuing to use our platform following such changes, all users and organizers of ETICKETS platform agree to be bound by such modifications. In the event of discrepancies between the Chinese and English versions, the English version shall prevail.



General

1.0

The Company may prohibit any users from using the Service in its sole discretion at any time for any reason, and is not liable for any damage or loss resulting from such prohibition.

2.0

You are responsible for using the Service in a private and secure manner. The Company is not liable for any damage or loss due to unauthorized account access resulting from your actions.

3.0

You may not use the Service for any illegal activity or to violate laws in your jurisdiction.

4.0

You may not use the Service to distribute unsolicited email (“spam”) or malicious content such as viruses or worms.

5.0

You may not exploit the Service to access unauthorized information.

6.0

Any abuse or threatened abuse of other users of the Service or of Company personnel will result in immediate account termination.

7.0

Any failure of the Company to enforce or exercise a right provided in these terms is not a waiver of that right.

8.0

Should any provision of these terms be found invalid or unenforceable, the remaining terms shall still apply.

9.0

This Terms of Service constitutes the entire agreements between you and the Company and supersedes any and all previous agreements, written or oral, between you and the Company, including previous versions of the Terms of Service.

10.0

These Terms of Service shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without giving effect to principles of conflicts of law. You and the Company each agree that any action at law or in equity arising out of or relating to these Terms of Service will be filed only in the courts in and for Hong Kong Special Administrative Region, and hereby consent and submit to the personal and exclusive jurisdiction of such courts for the purposes of litigating any such action.

11.0

The Company reserves the right to modify, suspend, or discontinue the Service for any reason, with or without notice.



User Conduct and Submissions

1.0

Subject to the license granted below, any remarks, ideas, graphics, photographs, or other information (collectively, “Content”) communicated to the Account Holder (as defined below) and posted on the Service in a Hosted Area (as defined below) belong to the person who posted such content. You may use any Content posted by you in any other way without restriction. You may only use Content posted by others in the ways described in these Terms of Service.

2.0

You give the party (the “Account Holder”) who owns the domain name as hosted on the Service in which you post your Content (the “Hosted Area”) a non-exclusive, royalty-free, worldwide, perpetual, irrevocable , fully-sublicensable license to publish and use your Content. In addition to the right to publish, you also grant the Account Holder under said license the following rights, without limitation: (i) the right to reproduce or copy or create derivative works thereof; (ii) the right to transfer, deliver, and sell the Content, which includes the distribution via computer and networks; (iii) the right to edit, modify, adapt, arrange, improve, correct, develop, translate, in all or in part; (iv) the right to update/upgrade by adding or removing; (v) the right to film, perform or post the Content in any media, and (vi) the right to use or incorporate all or any part of the Content in any products or services of the Account Holder (whether or not associated with the Service). Except as described in our Privacy Policy, neither the Company nor any Account Holder will be required to treat any Content as confidential. By posting Content you hereby waive any and all rights to be compensated by ETICKETS or any Account Holder for such Content.

3.0

In order to operate and improve the Service, the Company needs the right to make certain uses of your Content as well. Therefore, when you post Content in any Hosted Area, you also agree to grant the Company an irrevocable, perpetual, worldwide, royalty-free, fully sublicenseable, non-exclusive license to copy, distribute, sell, publicly display, publicly perform and make derivative works of your Content on the Service and on services affiliated with the Service regardless of the form of media used or of whether such services now exist or are developed in the future.

4.0

The submission of your Content on the Service is entirely voluntary, non-confidential, gratuitous, and non-committal. You understand that the Account Holder may be working on the same or similar Content, that it may already know of such Content from other sources, that it may simply wish to develop this (or a similar Content) on its own or it may have taken/will take some other action. In return for the Account Holder’s review and consideration of your Content, you acknowledge that you have read, understand and agree to the terms enumerated below, and further agree that these terms shall apply to any additional material previously or later submitted:

The Content represents your own original work. You have all necessary rights to disclose the Content to the Account Holder. In doing so, you are not violating the rights of any third party and you know of no other individual or entity whose rights will be infringed upon by the Account Holder’s review and/or use of the Content.

You understand that disclosure of Content to the Account Holder does not establish a confidential relationship or obligate the Account Holder to treat your Content (or any related materials) as secret or confidential.

You understand that the Account Holder has no obligation, either express or implied, to develop or use your Content and that no compensation is due to you or anyone else for any inadvertent or intentional use of your Content, related ideas or ideas derived from your idea. You understand that the Account Holder assumes no obligation with respect to any of your Content unless and until the Account Holder enters into a written contract with you, and then only as expressed in that contract. In the absence of a separate formal contract, your rights shall be limited to those existing under the patent laws of the the Hong Kong Special Administrative Region of the People's Republic of China.

If your Content is the subject of a pending or issued patent, you have disclosed or will disclose that fact to the Account Holder. To the extent you hold a patent in the Content, the Account Holder acknowledges that no license under any patent is herein granted to the Account Holder. Any license to use a patented Content shall be in the form of a written contract, in which event the Account Holder’s obligations shall be only those expressed in such contract.

The Account Holder will give your Content such consideration as is warranted by its sole judgment. The Account Holder’s review of your Content shall not be construed as any recognition of the novelty or originality of the Content. The Account Holder is not obligated to give reasons for rejecting your Content or to reveal the Account Holder’s activities that are related to the subject matter of the submitted Content.

Neither the discussion or negotiations between the Account Holder and you relating to the possible purchase or license of the Content, nor the making of any offer for the purchase or license of the Content, shall prejudice the Account Holder in any way, or be construed as recognition of the novelty, originality, priority, other rights or value of the submitted Content. Further, the Account Holder’s consideration or its discussions or negotiations with you will not in any way impair the Account Holder’s right to contest the validity or infringement of your rights.

You acknowledge that the Account Holder, directly or indirectly, may (i) be working on the same Content or a similar Content to the Content, or (ii) already know of such Content from other sources, or (iii) simply wish to develop this Content or as similar to the Content on its own.

You hereby irrevocably release and forever discharge the Company and all Account Holders and their affiliates and subsidiaries (together, the “Released Parties”) from any and all actions, causes of actions, claims, damages, liabilities and demands, whether absolute or contingent and of any nature whatsoever, which you now have or hereafter can, shall or may have against the Released Parties or their respecting successors and assigns with respect to the Content, including without limitation in respect of how the Company and its affiliates and subsidiaries, directly or indirectly, use the Content, with the sole exception in respect of the foregoing release and discharge being your right to bring a claim of patent infringement.

5.0

The Company has the right, but not the obligation, to remove Content that it determines in its sole discretion to be unlawful, offensive, threatening, libelous, defamatory, obscene or otherwise objectionable, that violates any party’s intellectual property, or that is detrimental to the quality or intended spirit of the Service. The Company also has the right, but not the obligation, to limit or revoke the use privileges of account of anyone who posts such Content.

6.0

The Company reserves the right to remove any Content from the service, at its sole discretion, including unacceptable content.

7.0

Examples of unacceptable Content or behavior on the Service include:

- abuse, harassment, threats, flaming or intimidation of any person or organization

- engaging in or contributing to any illegal activity or activity that violates others’ rights

- use of derogatory, discriminatory or excessively graphic language

- providing information that is false, misleading or inaccurate

- hacking or modifying the Company Service or another Web site to falsely imply an association with the Company

- implying or pretending to be affiliated with a company or organization with which you are not affiliated, or misrepresenting the extent of your affiliation or role with an affiliated company or organization

- transmitting worms, viruses or harmful software

- sending spam

- disclosing personal or proprietary information of another user, person or organization.

8.0

The Company cannot control all Content posted by third parties to the Service, and does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Service you may be exposed to Content that you may find offensive, indecent, incorrect or objectionable, and you agree that under no circumstances will the Company be liable in any way for any Content, including any errors or omissions in any Content, or any loss or damage of any kind incurred as a result of your use of any Content. You understand that you must evaluate and bear all risks associated with the use of any Content, including any reliance on the content, integrity, and accuracy of such Content.



Sales & Refund Policy

All item/ticket(s) are sold/issued in the project pages on the ETICKETS platfrm on behalf of the organizers. All payments are under the sales and refund policy. All users (either Organizers or Attendees) of ETICKETS platform agree the sales and refund policy

1.0 Online Payment

We accept the online payment in Hong Kong currency (HKD$) only. Unless otherwise stated, payment in Hong Kong currency only may be made by: (1) Credit cards payment (including VISA Cards, MASTER Cards, AMERICAN EXPRESS Cards, JCB Cards, Discover Cards, Diners Club Cards), (2) Apple Pay payments, (3) Google Pay payments, (4) Microsoft Pay payments, (5) the China UnionPay cards, (6) Paypal online payment and (7) Alipay online payment (8) WeChat Pay online payment. It appears ETICKETS.HK in the user's card statements.

2.0 Refund and Cancellation

All organizers in our platform agree to our sales & refund policy. Attendees can apply refund and cancellation to request refund from organizer within 7 days after the date of purchase and at least 7 days before project launch, otherwise all item/ticket(s) sold are non-returnable and non-exchangeable. For a success refund, the purchase price of the item/ticket(s) with service fee will be refunded to the holders of original item/ticket(s) only. All item/ticket(s) are fully refundable within 7 days after the date of purchase and at least 7 days before project launch.

3.0 Cancellation and Postponement of Project (Organizer)

For any project cancelled or postponed, the organizer shall be responsible for refunding the purchase price of the item/ticket(s) and the refund shall be made to the holders of the online payment account only.

4.0 Late-comers

The management policy of the venue is under the venue management and the organizer. The management of the venue where the project takes place reserves the right to refuse admission by any late-comers to the event. The venue management and organizer also reserves the right to determine the time at which and the manner in which late-comers are to be admitted.

5.0 Payout Withdrawal (Organizer)

The total sales profit (sales minus service fees and processing fees) will show in the account balance under organizer account. For the project transactions through non-api payment, after the project's end date, the organizer can apply payout withdrawal to transfer the payout from the account balance that reached HKD$1,000.00 or above to the local bank account. If the payout withdraws less than HKD$1,000.00, the bank transfer fee is HKD$10.00. To avoid transfer failures and return fees of HKD$100.00, the name of bank account holder must match the name of organizer account registered in ETICKETS platform. All transfers are in Hong Kong currency (HKD$). The approximate processing time of payout withdrawal is 7 business days. The time it takes for the transfers to be posted the organizer's bank account varies depending on the local bank. There are 4 statuses for the payout withdrawal:

Status 1 - Pending
Organizer has already applied payout withdrawal. It means we got your pending and verify the or bank account information of the organizer for the bank transfer.

Status 2 - Processing
It means we're processing and delivering the bank transfer request to the organizer's bank. The approximate processing time of payout withdrawal is 7 business days (7-14 business days for the bank transfers outside Hong Kong). It will indicate the initiated date of transfer.

Status 3 - Success
It means the payout are being moved to the organizer's bank and the payout process is successfully completed.

Status 4 - Returned
It means we attempted to send organizer payment, but the bank transfer failed and the payouts was returned to us. Please double check your bank account information is correct, then apply the payout withdrawal again.

6.0 Other payment methods through free ticket(s)

All free tickets are used for the ticketing of free admission, free ticket sales, free reservation and free registration. We DO NOT accept any free tickets sold by organizers charging with other unauthorized payments that are not listed in 1.0, such as bank transfer, wire-transfer and P2P-transfer. We are NOT responsible for any kind of litigation or any issue raised by free ticketing charged by other unauthorized payments.



Privacy and Cookie Policy

ETICKETS strictly respects the right to privacy of all users and organizers. In order to protect the interests of all involved parties by conforming to the latest amendments of Personal Data (Privacy) Ordinance (Cap. 486). governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, ETICKETS adopts the following policies on personal data regarding its acquisition, utilisation, archival, disclosure, transfer and access.

1.0 Collection and usage of personal data

Your personal information is gathered by ETICKETS on your registration and purchase as a user. This includes your name, gender, email address, contact number, date of birth, education level and office address. ETICKETS and its associated organizations and project organizers and parties process such information solely for marketing and publicity activities, including but not limited to the following purposes:

To inform you about the latest news of ETICKETS platform, including both our constituent and subsidiary organisations, along with our affiliations and associated organizations and project organizers and parties. These updates are composed of but not restricted to programme highlights, education activities and course information, discounts, benefits and promotions, newsletters, as well as information of workshops, talks, seminars and other related events.

2.0 Collection and usage of non-Personal data

As non-personal data cannot be used to personally identify you, we may use such information in our platform for any lawful purpose.

3.0 Protection of personal data

All personal information is used for the aforesaid purposes by ETICKETS and its associated organizations and project organizers and parties. All personal information collected is never sold, shared, leased nor transferred to any third parties whatsoever without your approval.

4.0 Cookies

Cookies belong to a type of compact data files encoded onto user hard discs via web browsers. Upon agreement by visitors for adding these files, cookies then track website traffics and keep you a copy of browsing record for reference. Catering to the various requirements and preferences of visitors, internet server collects information to adjust browsing and deliver corresponding feedback data in return.

ETICKETS determines hit counts on our specific web pages by computing statistical data on cookies. Such website analytics is beneficial to our web optimisation directed to your needs. Data collected from visitors is used for such analysis only and is deleted from the system immediately afterwards. Website visitors can choose to accept or decline cookies. Most browsers automatically accept cookies, but cookies can be rejected by modifying browser settings. However, this may prevent visitors from getting the most from the website. Essentially, cookies not only help us build a better website for you, but also improve our services by monitoring your web history. Unless you choose to share your data with us, cookies can never disclose your information to us nor enable connection between the servers of ETICKETS and your computers.

5.0 Links

Project organizers and companies linked to the website of ETICKETS platform may collect user’s personal information as well. That policy may differ from ours. We encourage visitors to further understand the details of the privacy protection policies of our organizers and our linked websites. The ETICKETS is not responsible for the privacy practices or the content of websites other than etickets.hk.

6.0 Updates on personal data

Welcome to update your pesonal information on ETICKETS platform under User Profile, that you can help the ETICKETS maintain the accuracy of your personal information by notifying us when you change your address, contact number, or e-mail address or in case you believe the personal data given to us is incorrect or incomplete, please write or email us as soon as possible. We will then quickly update our records. We maintain the right to renew the conditions listed on this privacy statement without prior notice. We encourage you to visit our website periodically to check our latest updates and related changes.
